General Terms and Conditions (GTC) for STRAMM Design UG (haftungsbeschränkt)

1. Scope of Application

These General Terms and Conditions apply to all orders placed through the STRAMM DESIGN online shop (www.strammdesign.com) by consumers within the European Union. Consumers, within the meaning of these GTC, are natural persons who conclude a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 German Civil Code (BGB)).

2. Contracting Party

3. Conclusion of Contract

  • The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
  • By clicking the "Buy Now" button, you place a binding order for the goods contained in your shopping cart.
  • We will confirm receipt of your order immediately by email. This confirmation does not yet constitute the conclusion of a contract.
  • The purchase contract is only concluded with our order confirmation by email or by dispatch of the goods.

4. Prices and Shipping Costs

  • All prices are final prices including statutory VAT.
  • We offer free shipping within the EU. Outside the EU, shipping costs may apply and will be marked accordingly.
  • We deliver throughout Europe. Delivery times are displayed in the shop for each product but can take up to 4 weeks due to the production of items after an order has been received.

5. Payment Terms

Accepted payment methods:

  • PayPal
  • Klarna (Invoice, Installment Purchase, Sofort)
  • Shopify Payments (Credit cards, e.g., Visa, Mastercard)

Payment is due immediately upon conclusion of the contract, unless otherwise agreed.

6. Delivery and Shipping

  • Delivery is made by Hermes or DPD to the delivery address provided by the customer.
  • Delivery times: as indicated in the shop.
  • Should a product not be available, we will inform you immediately and, if applicable, refund any payments already made.

7. Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving any reason.

  • Start of the withdrawal period: Receipt of the goods by the consumer.
  • To exercise the right of withdrawal, the consumer must inform us by email at: shop@strammdesign.com.
  • Consequence of withdrawal: Refund of all payments including shipping costs, return of the goods by the consumer at their own expense.

8. Retention of Title

The delivered goods remain our property until full payment has been received.

9. Warranty / Liability

  • The statutory warranty rights apply.
  • For damages not arising from the delivery item itself, we are only liable in cases of intent or gross negligence.

10. Data Protection

11. Applicable Law and Jurisdiction

  • The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  • The place of jurisdiction for consumers within Germany is the location of our company.

12. Final Provisions

Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
